The use of a bicycle requires physical fitness, legal adulthood, and technical proficiency of the rider. By renting the bicycle, the User declares to possess the necessary skills and competence without any reservations. The use of bicycles by minors is allowed only with prior consent from a parent or guardian. Minors may only use the bicycle if accompanied by an adult. In any case, the Rental Provider excludes any liability in favor of the minor. The minor is under the responsibility of the adult who has rented the bicycle on their behalf.
Bicycles may only be used as a means of transport for tourism purposes and must be treated with care and attention to avoid any damage. The use of bicycles for competitive sports, racing, jumping, stunts, or similar activities is strictly prohibited.
The bicycle may not be transferred to other individuals. It is also prohibited to transport the bicycle on private or public vehicles or to install private accessories or mounts not authorized by the Rental Provider.
The User is responsible for the bicycle until it is returned to the Rental Provider. The User is also personally responsible for any damage caused to themselves, the bicycle, third parties, or property during the rental period. No compensation can be claimed from the Rental Provider.
During the rental period, the User is not covered by any insurance, nor is the bicycle covered by liability insurance. The User must comply with the current regulations of the Highway Code as well as the provisions of the Civil Code. The Rental Provider disclaims all liability in case of improper use of the bicycle or failure to comply with applicable regulations.
Before receiving the bicycle, the User must present a valid identity card (or another valid photo ID) and consent to the processing of their personal data solely for rental purposes.
By taking possession of the bicycle, the User confirms that it is ready for use and in good maintenance condition.
The Rental Provider may conduct checks on the User during the rental period and may request the immediate return of the bicycle if it detects non-compliance with these terms and conditions or improper use of the bicycle. The Rental Provider reserves the right to refuse rental to persons who are intoxicated, under the influence of drugs, or for other reasons at its sole discretion.
In case of loss of bicycle accessories or rented equipment, all replacement costs shall be borne by the User. In case of damage to the bicycle, equipment, and/or rented accessories, all costs necessary to restore them to their original condition shall be charged to the User. The cost estimates for replacement and/or repairs will be provided directly by the Rental Provider. In case of theft and/or total loss, the User must compensate the Rental Provider for the full retail value of the bicycle. The rental prices are based on the Scott price list. In the event of bicycle theft, the User must submit a copy of the theft report filed with the competent authorities to the Rental Provider on the same day and simultaneously pay an amount equal to the value of the stolen bicycle. If the bicycle is recovered, the amount will be refunded to the User after verification and deduction of any damages sustained.
The bicycle must be returned to the same location where it was delivered (unless otherwise agreed with the Rental Provider) and within the expressly agreed rental period. If the bicycle is returned outside the agreed rental period without prior authorization, a penalty of €25.00 per hour or fraction thereof will be applied. Failure to return the bicycle without prior communication and authorization from the Rental Provider will be considered as theft and will be immediately reported to the competent judicial authorities.
The User may request the Rental Provider to collect the bicycle at a different location from the agreed drop-off point at a cost of €35.00 within a 10 km radius from the original agreed location. For longer distances, the cost will be determined on a case-by-case basis. The collection time must be agreed upon by phone based on availability. In any case, the User remains responsible for the bicycle and all rented equipment and accessories until the bicycle is returned. The Rental Provider is not obliged to provide this additional service; therefore, failure to provide it cannot be considered as a breach of contract.
By renting and using the bicycle the User confirms that they know and accept unconditionally these Rental Terms and Conditions, the rental prices and the rental times. The bicycle Renter is Siena Vélo Srls, with registered office at no. 13 Via Biagio di Montluc, 53100 Siena – VAT No. 02612100210 and operational headquarters at no. 54 Via Girolamo Gigli, 53100 Siena.
Rental bookings may be cancelled as follows:
14 or more days before the rental start date: reimbursement of 70% (seventy percent) of the amount paid;
from 13 to 8 days before the rental start date: reimbursement of 50% (fifty percent) of the amount paid;
7 or less days before the rental start date: no reimbursement;
No reimbursement for Rental bookings in the Gran Fondo Strade Bianche week;
without prejudice to any other agreement between the Renter and the User.
When booking online, the rental is valid for all intents and purposes under the conditions set forth in these Rental Terms and Conditions.
All legal matters are subject to Italian law, even if the User is based abroad.
For matters not expressly covered in these terms and conditions, the relationship between the Parties (User and Rental Provider) is governed by the provisions of the Italian Civil Code.
SERVICE FEES AND DAMAGE COMPENSATION LIST
Bicycle collection at a different location within a 10 km radius: €35.00.
Bicycle collection beyond 10 km from the agreed location: to be determined.
Loss and/or damage to accessories: max. €50.00.
Bicycle damage: as per the spare parts price list.
Failure to return the bicycle: bicycle value as per Scott price list.
