- The use of our bicycles presupposes physical suitability, being of legal age, and the technical expertise of the rider. Therefore, the User, when renting a bicycle, declares they possess adequate skill and competence without any reservation. Minors are allowed to use our bicycles only with the written consent of a parent/guardian and only if accompanied by a person of legal age. In any event, the Renter waives any liability towards the minor. The minor is under the responsibility of the adult who rented the bike on their behalf.
- The bicycles are intended for use as a means of tourist transportation and should be treated with care to avoid damage of any kind. It is strictly prohibited to use them for competitions, jumps, stunts and the like.
- The bicycles cannot be used by anyone other than the person who rents it (the User). It is also forbidden to transport them on private or public vehicles and to install any accessory and/or bracket for private use not envisaged by the Renter.
- The User is responsible for the bicycle until its return to the Renter. The User is liable for any and all damages caused to themselves, the bicycle, third parties, and objects during the rental period. No compensation may be claimed from the Renter.
- During the rental period, the User has no insurance coverage, and the bicycle is not covered by third-party liability insurance. The User must therefore comply with road traffic regulations and the provisions of the Civil Code. The Renter waives any and all responsibility in the event of improper use of the bicycle or failure to comply with current regulations
- Before collecting the bike, the User is required to present their valid ID card (or other valid document with photo) and consents to the processing of their personal data solely for the purposes of the rental service.
- By accepting the bike, the User confirms that it is ready to be used and well-maintained.
- The Renter is entitled to conduct checks on the User during the rental period and to request the immediate return of the bike if the Renter deems that the provisions of these Rental Terms and Conditions are not complied with or the bike is not being used properly. The Renter is entitled to refuse rental to persons under the influence of alcohol and/or drugs and for other reasons at the Renter’s sole discretion.
- In the event of loss of bike accessories and rented equipment, all replacement costs shall be borne by the User. In the event of damage to the rented bike, accessories and/or equipment, all costs for repairs required to restore them to their original state shall be charged to the User. Cost estimates for replacements and/or repairs shall be provided directly by the Renter. In the event of theft and/or total loss, the User is under the obligation to reimburse to the Renter the full amount of the listed price of the bicycle. The prices of the rented models are those of the Scott price list. In the event of theft of the bicycle, the User must give the Renter a copy of the theft report to the competent authorities on the same day the report is filed. At the same time, the User is obliged to pay the Renter the full amount of the price of the stolen bicycle; if the bicycle is recovered, the amount shall be reimbursed to the User, subject to verification and charge for damages caused to the bike.
- The bicycle must be dropped-off at the same place where it was collected (unless otherwise agreed with the Renter) at the time expressly agreed upon when renting. In the event the bike is dropped-off outside rental hours without the Renter’s consent, a penalty of €25.00/hour or fraction of an hour shall be charged. Should the User not return the bicycle without prior notice to and authorisation by the Renter, this shall be considered a crime of theft and therefore immediately reported to the competent authorities.
- The User may ask the Renter to collect the bicycle in a place other than the agreed drop-off point at a cost of €35.00 within a radius of 10 (ten) km from the original drop-off point. For greater distances, the cost shall be agreed upon on a case-by-case basis. The time of collection must be agreed on by phone based on availability. In any event, the User is responsible for the bicycle and all equipment and accessories rented until the return of the bicycle. The Renter is under no obligation to provide this additional service. Therefore, failure to provide this service shall not be considered as non-fulfilment of the Renter’s obligations towards the User.
- By renting and using the bicycle the User confirms that they know and accept unconditionally these Rental Terms and Conditions, the rental prices and the rental times. The bicycle Renter is Siena Vélo Srls, with registered office at no. 13 Via Biagio di Montluc, 53100 Siena – VAT No. 02612100210 and operational headquarters at no. 54 Via Girolamo Gigli, 53100 Siena.
- Rental bookings may be cancelled as follows:
- 21 and more days before the rental start date: full reimbursement of the amount paid;
- from 14 to 20 days before the rental start date: reimbursement of 70% (seventy percent) of the amount paid;
- from 13 to 8 days before the rental start date: reimbursement of 50% (fifty percent) of the amount paid;
- 7 or less days before the rental start date: no reimbursement;
without prejudice to any other agreement between the Renter and the User.
- When booking online, the rental is valid for all intents and purposes under the conditions set forth in these Rental Terms and Conditions.
- All legal actions are subject to the laws of Italy, even if the User resides or is domiciled abroad.
- For all matters not expressly provided for in these Rental Terms and Conditions, the relationship between the Parties (User and Renter) shall be governed by the provisions of the Italian Civil Code.
PRICE LIST FOR SERVICES AND COMPENSATION FOR DAMAGES, IF ANY
- Collection of the bike at a place other than the agreed drop-off point, within a radius of 10 km: €35,00.
- Collection of the bike at a distance greater than 10 km from the agreed drop-off point: to be agreed upon on a case-to-case basis.
- Lost and/or damaged accessories: max. €50,00.
- Damages to the bicycle: as per spare parts price list.
- Bike not returned: price of the bicycle as per Scott price list.
